The following are the terms and conditions for use of JobUP  services.

By using JobUP as a recruitment tool, you are explicity agreeing to be bound by these terms and conditions.

Article 1: Field of Application

The present conditions of sale are applicable to all sale or services provided by JobUP. Without expressive convention the present conditions may not be cancelled or modified by any other clauses or conditions.

Article 2 : Order 

An order of sale implies that the present conditions are accepted.

The services are validated through an ordering form addressed to JobUP or a written contract on which the service being offered is explained.

JobUP reserves the right to refuse any order which does not correspond to its scope of activity or which cannot be executed in the scope of the demands of the client.

JobUP reserves the right to withdraw applications, advertised positions or in other cases to close the accounts of members that misuse the service. Misuse includes, but is not limited to, job postings or applications of racist, abusive or inappropriate nature.

JobUP formally forbids any reselling of its services.
Moreover, it is formally forbidden to share or to give access to the JobUP services  to a third party by transmitting the username and password.

Article 3 : Payment Conditions

Article 3-1 : Price

Invoices are sent based on the prices valid at the time of the order or the prices mentioned in the contract. Our prices do not include VAT ( TVA ). The valid prices are the prices as published on the web site or on our documents.

We reserve the right to modify our prices. The prices applicable will be those valid the day of the order.

Increases or decreases in our prices are not applicable to services already being provided. 

The execution of a service at a given price does not create an obligation for JobUP to execute a service at a later period at the same conditions.

Article 3-2 : Payment 

All our invoices are payable in postal or by bank transfer net at 10 days.

Article 4 : Responsibility

JobUP uses all means at its disposition to ensure the best quality of service available.

However, JobUP cannot be held responsible for interference on the Internet or electricity networks.

Moreover, JobUP can not be held responsible for the quality and quantity of candidatures received or consulted through its services. In fact, JobUP does not enter in the process of candidates selection. The potential employer of the candidate is responsible to verify the truthfulness of the information contained in the candidates CV.

If JobUP is proven responsibility in bad execution of the services prescribed, the client cannot claim more damages than the reimbursement of a part of the payments made. The amount of reimbursement will be calculated according to fixed installation fees and the period of the subscription that has passed.

Article 5 : contract renewal

A contract concluded for a determined period is automatically renewed with the same conditions. If the prices or other conditions were to change, JobUP will submit a new proposal to the client.
If the client does not wish to renew their contract, he needs to inform JobUP using a written form ( fax, post or e-mail) before the contract expires.

Article 6 : "Force Majeure" and Cancellation

"Force Majeure" is defined as any exterior, unpredictable or involuntary event that provides an obstacle to normal execution of our services.

In the case of a "Force Majeure" or one recognized as such by Swiss Jurisprudence, the obligations related to the the order in question will be suspended during its entire period. If the "Force Majeure" has a duration longer than 30 days, the order in question will be cancelle, eight days following the sending of a registered letter.

Moreover, JobUP reserves the right to cancel any contract at any time, without giving a motivation. In this case, JobUP will reimburse the client the pro-rata amount of the sum paid.

Article 7 : Applicable Law and Jurisdiction

The present conditions are subject to Swiss Law, regardless of the country of origin of the client.

Any disagreement relating to the interpretation of the execution of an order or to our services will be treated by the competent tribunals of the canton of Geneva
