The Department of Community and Primary Care Medicine (DMCPR) has the societal mission to provide access to quality care for all through proximity medicine, to ensure the management of minor medical and surgical emergencies, to promote prevention among citizens, to provide medical knowledge for judicial investigations, and to promote the health of travelers.
Due to the versatility of its skills, the Romand University Center of Forensic Medicine (CURML) is tasked with responding to all requests for expertise or advisory assistance in the medico-legal field, medical law, and doping analysis. Located in the Lake Geneva region, its area of competence operates at regional, national, and international levels.
Article 12 of the Health Law of 7.4.2006 (LS; K 1 03) establishes a superior authority for lifting professional secrecy, the Professional Secrecy Commission, responsible for ruling on requests to lift professional secrecy in accordance with art. 321 ch. 2 CPS as well as arts. 55A and 86 LS.
The Commission is chaired by a CURML physician and is administratively attached to the Department in charge of health (art. 12 para. 6 LS). It exercises the powers conferred by the LS independently (art. 12 para. 7 LS). Decisions made by the Commission may be appealed to the Administrative Chamber of the Court of Justice within 10 days of their notification (art. 12 para. 5 LS).
Job Description
As a legal officer, you provide legal expertise in managing and controlling the process of handling requests to lift professional secrecy submitted by health professionals.
You ensure, in collaboration with the presidency and the Commission, that the legal conditions related to lifting professional secrecy are properly applied, and you verify the admissibility of requests.
In collaboration with the secretariat and the presidency, you participate in preparing weekly meetings, notably by ensuring the availability of the necessary documents for processing requests and making them available to Commission members.
During meetings, you establish, together with the secretariat, the minutes of hearings and collect elements intended for the preparation of the meeting minutes.
At the request of the Commission or the presidency, you prepare legal analyses and legal opinions, and you draft appeals or responses to appeals related to the Commission's missions.
On occasion of sessions with courts, you collaborate with the presidency when it represents the Commission.
Qualifications
You have a solid legal education, preferably hold a lawyer's license, and possess knowledge of cantonal and federal law, including judicial procedures.
You are proficient in the German language.
You have two to three years of experience in a legal officer position or any equivalent role, as well as experience in health law.
You have the ability to manage stressful situations, demonstrate interpersonal skills, and possess a strong team spirit.
Your skills include efficiency, autonomy, and precision. You have a sense of meeting deadlines, diplomacy, and a high capacity for adaptation.
