General Terms and Conditions (GTC) of AZ Breitlen AG
(hereinafter referred to as Spitex Hombrechtikon)
These GTC are part of the framework agreement and are handed over to the client before signing the framework agreement.
1. Contracting parties and legal basis.
Spitex Hombrechtikon and the client enter into a contractual relationship by signing the
framework agreement, for which they declare these general
terms and conditions applicable. Unless otherwise specified in the framework agreement and these general terms and conditions,
the provisions of the Swiss Code of Obligations (CO) apply, in particular the
provisions on the mandate (Art. 394 et seq. CO).
2. Framework conditions and Spitex services in general
Spitex Hombrechtikon provides its services within the framework of the
service agreement with the municipality of Hombrechtikon and based on the guidelines and
recommendations of its umbrella organizations. These may be adjusted during the term of this
contractual relationship.
Spitex Hombrechtikon supports the client with nursing, domestic, advisory or social care services in the sense of supplementary help and care at home. The resources of the client and their relatives as well as the social environment are taken into account and included.
If private providers or employees provide services alongside Spitex Hombrechtikon,
Spitex Hombrechtikon strives for coordination regarding
quality of care, division of individual tasks and responsibilities as well as
determination of deployment times and hours.
3. Contractual obligations of Spitex a. Periodic needs assessment
Spitex Hombrechtikon periodically assesses the help and care needs of each client usually at home. The electronic assessment tool "Inter RAI-HC" is used for the needs assessment. If necessary, the parties adjust the scope of services to the changed circumstances. All services are documented in writing. The client acknowledges that the scope of nursing services paid by health insurers is limited.
The needs assessment for nursing services is subject to insurance and will be charged in any case. For domestic services, the health insurer decides whether services from supplementary insurance are paid.

b. Provision of services
Spitex organizes and schedules the services. This includes the following:
It usually assigns a specific case manager as the direct contact person of Spitex to the client, their relatives, and any other involved parties (e.g., the family doctor).
It determines the employees for the respective assignments. The client cannot choose who will perform the assignment. The assignments are usually carried out by different employees. The right to issue instructions to the employees lies with Spitex Hombrechtikon.
It agrees with the client on time windows in which the assignments will be carried out. If an assignment cannot be performed within this time window, the client will be informed by phone if possible.
Spitex Hombrechtikon is entitled to discontinue an ongoing or upcoming service assignment if it is unreasonable. Reasons may include professional or medical grounds, violence, sexual assaults, gross insults, or a health hazard to employees.
c. Confidentiality and data protection
Spitex Hombrechtikon obliges its employees to maintain confidentiality and comply with applicable data protection regulations.
Spitex Hombrechtikon processes personal data in compliance with the applicable data protection law. The collection and processing of personal data by Spitex Hombrechtikon is explained in the privacy policy.
If an electronic patient record (EPD) is available, the client informs Spitex Hombrechtikon about its access rights so that Spitex Hombrechtikon can have the documents necessary for optimal care and can fulfill its duties according to the EPD regulations. Spitex Hombrechtikon follows national and cantonal legislation and official recommendations.
To the extent necessary to fulfill the contract, personal data of the client may be transmitted to health insurers, doctors, care institutions, control and arbitration bodies, as well as government authorities. Spitex Hombrechtikon ensures that access to files is limited to those actually needed in each case.
The client expressly agrees to this use of data. The client releases the involved service providers from confidentiality.
By signing the framework contract, the client confirms agreement to these regulations.
d. Liability
Spitex Hombrechtikon is liable for damages caused intentionally or by gross negligence by employees. Any further liability is excluded.
e. Gifts to employees
Employees are prohibited from accepting gifts or other benefits for themselves or others or from being promised such.
If clients and relatives wish to give donations, these fall to the employer. Designated donations must be handled accordingly.

be accepted (max. CHF 20.00). They flow into a common personnel fund of Spitex Hombrechtikon.
4.
Client obligations
The client is usually present during assignments, shows the Spitex employees due respect, and participates in the assignment as much as possible.
Cancellations of assignments must be communicated to Spitex Hombrechtikon as soon as possible.
The client adjusts the home furnishings and materials as needed for safety and accident and illness prevention and accepts the care materials used by Spitex Hombrechtikon. The means for basic and treatment care as well as domestic services are usually kept with the client.
The client obtains prescribed medications themselves or commissions Spitex Hombrechtikon early and at their own cost.
If necessary, the client hands over a house or apartment key to Spitex Hombrechtikon against receipt. If Spitex Hombrechtikon does not have a key and one cannot be made available immediately, it may have the locked front door professionally opened at the client's expense if there is suspicion that something has happened to the client.
Time and kilometers for trips on behalf of the client are charged. Transport of clients and their relatives in Spitex-owned or private vehicles is only permitted to employees in exceptional cases.
5.
Rates and invoicing
The price for Spitex Hombrechtikon services is based on the rate list, which is an integral part of this agreement. Prices may be adjusted. Prior notice will be given about price adjustments.
Spitex Hombrechtikon invoices all services, including needs assessment, administrative work, clarifications with third parties, time and expenses for purchases, travel expenses, etc., regardless of whether costs are covered by mandatory or private health insurance. Assignments canceled by the client less than 48 hours in advance from Monday to Friday are also invoiced as non-insurance services.
Spitex Hombrechtikon invoices nursing services from the mandatory basic insurance (KLV) directly to the health insurance.
Patient co-payments are invoiced directly to the client.
Invoicing for domestic and other non-insurance services is also done directly to the client.
Invoicing is done monthly with a payment term of 30 days.
The needs assessment for nursing services is subject to insurance and will be charged in any case. For domestic services, the health insurer decides whether services from supplementary insurance are paid.
6.
Termination of the contract
The client and, in justified cases, Spitex Hombrechtikon have the right to terminate the contractual relationship at any time in accordance with Art. 404 CO. Usually, the parties terminate the contractual relationship when no further assignments are necessary.

7. Dispute resolution and jurisdiction
Employees of Spitex Hombrechtikon receive complaints from the client and forward them to the superior authority. This authority strives, if necessary involving the Spitex management or the management of AZ Breitlen AG, to find an amicable solution. For legal disputes arising from this contract, the ordinary court at the seat of AZ Breitlen AG has jurisdiction.
