Litigation & Bankruptcy Manager
Job Description
Your mission:
Within FER CIAM Geneva, you play a key role in managing and securing the receivables of affiliated institutions. You oversee litigation, debt collection and bankruptcy cases, monitor civil and criminal procedures as well as damage compensation actions, while supporting affiliates and working closely with authorities and internal partners. Your rigour and expertise ensure effective case management and the protection of the interests of the represented institutions.
Your main activities:
Management of bankruptcy procedures
• Receive and process acts from debt enforcement and bankruptcy offices, prepare claims submissions, control payments and movements (allocation, cancellation of enforcement, fee claims)
• Check acts of lack of assets, seizure reports and ranking statements, and initiate necessary follow-up actions
• Monitor release procedures, manage correspondence and associated costs, and maintain a strict schedule of cases.
Damage compensation actions and criminal procedures
• Draft decisions and follow civil procedures against responsible bodies (ARD) within the CIAM framework
• Draft criminal complaints (CIAM and CIEPP) and follow criminal procedures initiated against companies and their bodies
• Allocate payments received within criminal procedures and ARD actions, and monitor arrangements related to all procedures.
Relations with affiliates, legal department support, involvement in IT projects
• Welcome affiliates in person and by phone, and handle all correspondence related to their files
• Manage negotiations with affiliates and issue decisions on payment deferrals and arrangements, within the framework set by management
• Prepare file documents to be forwarded to the legal department for the most complex procedures
• Participate in the department’s IT projects, notably to ensure testing.
Profile sought
Your Profile
You hold a commercial employee CFC or an equivalent qualification
You have prior experience in litigation or in a debt enforcement or bankruptcy office
You hold a certified training in debt enforcement (an asset)
You have good knowledge of the taxation and collection of AVS/AI/APG/AC joint contributions and other dedicated tasks
You possess strong skills in analysing accounting movements, monitoring receivables and controlling payments
You have excellent writing skills and a perfect command of the French language
You are comfortable with common IT tools (Word, Excel and Outlook)
You are Swiss or hold a valid permit.
Skills and competencies
You have a strong interest in social insurance and/or the debt enforcement and bankruptcy law
You demonstrate organisation, reliability and precision in your work execution.
You have good listening skills and communicate clearly and diplomatically
You are able to work independently while valuing mutual support, collaboration and a positive working atmosphere.
